Arbitration is Common
The most common type of family law in the US is called family arbitration. Family arbitration refers to disputes between:
- spouses over their financial property
- children’s education
- medical decisions
- other family problems
The court appoints a family arbitrator to resolve any disputes between parents regarding:
- child custody
- visitation
- child support
- other issues
These are usually non-profit organizations that provide unbiased mediation services for parents who are struggling with divorce or a divorce situation. They may be assisted by an attorney for complex situations.
In some instances, family arbitration is simply used to share financial resources among siblings. If one sibling is involved in a legal proceeding and the other is not, the court will appoint an arbitrator to divide any monies awarded. In this situation, both parents can seek the assistance of a family lawyer. However, family lawyers are not normally associated with any of these types of family arbitration cases. Family arbitration often uses the same principles as traditional civil courts, although in many states there are no restrictions on family court mediation or arbitration.
When a dispute arises between parents concerning custody, visitation, child support, or any other family matter, the family lawyer will first determine the best interest of the child or children involved. Then, if the court finds it beneficial, the family lawyer may attempt to negotiate an amicable settlement with the parent who is seeking to retain custody. The family lawyer may also represent the child or children’s best interest at all court hearings. Some people hire a family lawyer even before they have custody of a child.
A Family Lawyer for Family Law Proceedings
The role of a family lawyer is important in family law proceedings. The lawyer will review and evaluate the facts surrounding the case and determine if any child welfare and/or child protection laws are in conflict with the parents’ rights. If the family lawyer determines the family matter warrants legal intervention, then he or she will bring the case to court. Family lawyers may also petition the court to stop further child abuse or neglect from occurring. The family lawyer may also represent the child or children in the court if they have special needs, such as physical disabilities or emotional problems.
The role of the family lawyer is important for those in need of legal help. While the lawyer may only act as a neutral third party, the family lawyer can offer valuable advice regarding divorce proceedings, help clients navigate the judicial process, and help with property and inheritance issues.
